Article 1: Festival Held
The fifth edition of Festival PROTOCLIP will be held at Centre musical Fleury Goutte d'Or – Barbaraat the corner of rue de Fleury and rue de la charbonnière 75018 Paris (France), on October 2010.
The video clips selected to be part of the official competition will be disclosed and broadcasted one month prior to the dates of the festival, on the website www.protoclip.com by means of streaming so as to enable Internet users to vote for the best clip.
Three projections of the official selection will take place during the Festival in Paris (France).
Article 2: Organization
The organization of the Festival PROTOCLIP is undertaken by:

Article 3: Conditions for participation
The competition is open to independent video clips recently produced, that have not been multi-broadcasted on television channels dedicated to the video music.
The submission of a clip for the selection of the Festival PROTOCLIP requires the unconditional acceptance of the present conditions for participation that can be viewed and downloaded on the website of the Festival PROTOCLIP.
Participation is at no cost.
Article 4: Submission
The submission of a clip for the selection of the Festival PROTOCLIP is made in principle, through the website www.protoclip.com
Participants shall fill-in the registration form viewable and downloadable on the website of the Festival PROTOCLIP. When possible, participant shall upload their video clip in the area provided for this purpose. All fields referred to as "mandatory" by the use of the acronym “*” shall be filled-in so that the registration is validated. In addition, the participants shall endeavor to upload a photo + a CV of the clip-maker and a photo of the clip. The same information is required for registration by e-mail (registration form filled, terms and conditions for the participation to the Festival Protoclip duly executed by the participant, CV and photo of the clip-maker, photo of the clip, DVD, DV, CD Rom or QUICK TIME file of the video clip).
The deadline for submission of the video clips is set for October 10, 2009.
Upon actual receipt of the clip, the registration form duly completed and the present terms and conditions duly executed, Festival PROTOCLIP will send the clip-maker, the producers or/and any entitled person an email confirming receipt of the film which validates the registration to prequalify.
The media of the pre-selected clips will be stored in the archives of the Festival for a period of 3 years. All other media of the clips that were not selected will not be retained or sent back by the Festival.
Article 5: Sélection
The video clips are submitted for being part of a selection of an official competition. The selection committee will choose some twenty clips with a strong and innovative artistic vision among the submitted video clips. The selection will be made available on the website http://www.protoclip.com.
Article 6: Autorisation d’utilisation
The entitled person of a selected clip shall transfer the following rights to Festival PROTOCLIP, at no cost, on a non-exclusive basis, and on a non-commercial basis for the sole purpose of promoting video clips, the video clip makers and / or the Festival PROTOCLIP and its marketing tools (including but not limited to working papers, documents, press kits, magazines, newspapers, publications of all kinds, trailer, teaser, promoreel, making of, and dressing bonus DVD, posters, press kit… ): (i) worldwide rights of reproduction (“droits de reproduction dans le monde entier”), (ii) worldwide rights of representation (“droits de representation dans le monde entier”) of the video clip, of its images and of its music, in whole or in part, synchronized or not, and its secondary and derivative IP rights(“droits secondaires et dérivés”), this representation being achieved: (i) by any and all means and media known and unknown today, including, but not limited to: film, radio television, digital cable, DSL, DVB, H, IP, UMTS, EDGE, satellite, radio, "Online" networks, such as Internet… and (ii) by any and all broadcasting methods known and unknown today, including, but not limited to: free TV, pay TV, pay per view, video on demand, streaming, download, simulcasting… and (iii) on any and all media known and unknown today, including, but not limited to: videotapes, DVD, CDI, CD-ROM, DVD-ROM, BLUE RAY, HD DVD, phonograms, audiotapes, books, publications of all kinds, cover, communication media fixed or mobile…
For the sake of realizing the abovementioned representation, Festival PROTOCLIP will reproduce the video clips and adapt them exclusively for reasons of ergonomics, and for technical purposes, and so that the graphics match with terminals of reception.
Festival PROTOCLIP remains free to use or not the video clips.
Article 7: Duration of the license
This right of use takes effect upon receipt of the registration of the participant. It shall come to an end after two years have elapsed as of the end of the edition of the Festival PROTOCLIP to which the licensor has submitted his video clip.
Notwithstanding the foregoing, the right of use of the rewarded video clips will be granted for duration of 5 years as of the end of the edition of the Festival Protoclip to which the licensor has submitted his video clip.
Article 8: Warranty
Any director or producer participant warrants being the owner of any and all reproduction rights, of any and all representation and distribution rights in relation to the considered video clip. Furthermore, he warrants having obtained any and all necessary authorizations and approvals that may be required for the uses of the video clip referred to in Article 6 of these principles, by Festival Protoclip. In this respect, Festival PROTOCLIP expressly states that the use of any musical works that may or may not pre-exist to the video clip requires the granting of an authorization by the entitled of this musical work. The director and / or producer and / or entitled person acknowledges and warrants having obtained prior to the submission and registration of the video clip, any and all authorization or approval, and shall be solely liable for any and all damages that may occur as a result of a failure to require such authorization and/ or approval.
Any director, producer and/ or entitled person agrees to indemnify and hold harmless Festival Protoclip for any claim sought by any third party against Festival Protoclip howsoever arising, following the representation and the broadcast of the video clip.
Article 9: Jury and Rewards
The Jury of the Festival Protoclip, the public and the Internet users shall award several prizes. The entitled of a rewarded video clip shall undertake to mention this reward on any material published in relation to any broadcast and/or representation of the video clip after the Festival Protoclip. Each winning video clip will be rewarded by a specific diffusion with the sponsor of the festival PROTOCLIP, and for occasional promotion Festival Screenings.
Article 10: Liability of the organizers
The parties acknowledge that the Festival PROTOCLIP will be entitled to use the data collected through the registration forms in accordance with the principles set out by the Law No 78.17, of 6 January 1978. In accordance with the Data Protection Law (“Loi Informatique et Libertés), a participant shall have a right to access and to correct only the personal data that relates to him. In this respect, this right will be he exercised in notifying the Festival PROTOCLIP.
The Festival PROTOCLIP denies any liability in case of an unsatisfactory receipt or in the event of a lack of receipt, whatever the reason, of the registration forms and of the video clips.
Article 11: Amendment, Cancellation, Unforeseen cases
Festival PROTOCLIP remains entitled, either to shorten, modify or cancel the festival or to modify its content, in the event of exceptional circumstances, beyond its control, arise. Its liability will not be incurred as a result. No compensation of any kind whatsoever can be granted to the participants.
Festival PROTOCLIP and the organizer of Festival Protoclip shall endeavor to settle any and all cases not covered by these principles, and may grant derogations to the abovementioned provisions, when necessary.
Article 12: Dispute
Any dispute in relation to the interpretation or implementation or performance of these principles will be subject to the discretion of Festival PROTOCLIP, without prejudice to any recourse to the Paris Courts (Tribunal de Grande Instance de Paris) which shall have sole jurisdiction.
